Facts of the Case

A 40-year-old husband stepped outside his family’s apartment one night to get something for his wife that she left in the car. On the way to the parking lot, the staircase railing, which protected tenants and guests from a 12- foot drop, collapsed as he grabbed on to it. He fell and shattered his left leg. After 18 months of medical care & surgeries, he was left permanently disfigured & barely able to walk.

The Problem

The apartment complex blamed him for the railing’s collapse. They claimed he’d been drinking or using drugs that night. They also said his poor medical outcome was the result of his smoking.


Our Approach and Solution

We worked with an engineer to show that the only reason the railing collapsed was due to wood rot, caused by a lack of proper maintenance. We also worked with medical professionals to show that the outcome of his treatment was only caused by the severity of his injury, not any fault of his own.
