The Role of a Guardian Ad Litem

In cases where a child is involved, the legal system wants to provide that child with additional protection. Whether it is for a divorce, custody issue, juvenile matter, adoption or another legal issue where the child is a party to the case, an attorney called a guardian ad litem (GAL) may be appointed. Their job is to advise the court on what is in the best interest of the child & act as an independent voice on the child’s behalf.


In divorce or custody modifications, each parent will likely have an attorney working on the behalf & arguing the parent’s perspective on what they believe is best for the child. A GAL on the other hand is only there to represent the child. Their legal opinion may or may not align with either parent because they are solely interested in what would be best for the child. They may be called as a witness in court proceedings to provide the judge with testimony. The judge will be interested in what they found during their representation, as well as their insights on the matter. They will also issue a legal opinion on what they feel would be the outcome best suited to the child’s interests.


GAL’s have the authority to file orders of protection on behalf of the child if they feel the child is in danger from one or both parents. They are there to protect the child & will assuredly bring any concerns to the attention of the court. This ensures the child’s safety & well-being during the case.
